Digital Product Policy and Terms of Use for Audio Recordings

This policy governs the purchase and use of all digital audio recordings (the "Digital Product" or "Recordings") sold by Hypnotic Mind Adventures ("We," "Us," or "Our"). By purchasing, downloading, or accessing the Digital Product, you ("Customer" or "You") agree to be bound by these terms.

1. License and Permitted Use (What You Can Do)

Your purchase grants you a single, non-exclusive, non-transferable license to use the Digital Product for the following limited purposes:

Personal Listening

You may download the Recordings to your personal devices (e.g., computer, smartphone, tablet) for private, non-commercial listening.

Backup Copies

You may make a single backup copy of the original file for archival and security purposes only.

​Gifting

You may not give away, transfer, or sell the Digital Product to another person. A separate purchase is required for each user.

2. Strict Usage Restrictions (What You Cannot Do)

The following actions are strictly prohibited and constitute a breach of this policy:

Redistribution/Sharing

You may not share, sell, sublicense, rent, lend, or otherwise distribute the original audio files to any third party, whether for free or for profit.

Commercial Use

You may not use the Recordings in any commercial setting, including: in your own services, for background music in public spaces (e.g., yoga studios, clinics, events), or as part of a product you sell.

Public Performance

You may not publicly broadcast, stream, or perform the Recordings.

 

Creation of Derivative Works

You may not modify, remix, adapt, or incorporate the Recordings into other products (e.g., adding a voiceover to the music) to sell or distribute.

Circumvention

You may not bypass, disable, or attempt to circumvent any digital rights management (DRM) or technical protection measures applied to the Recordings.

3. Intellectual Property and Ownership

  • Ownership: The Recordings, and all intellectual property rights therein (including all copyright and trademark rights), remain the sole and exclusive property of Paul Hayden Wattam and Hypnotic Mind Adventures at all times.

  • No Transfer of Rights: You are purchasing a license to use the content, not ownership of the content itself. You may not claim the Recordings as your own.

  • Enforcement: We reserve the right to seek financial and/or injunctive relief for any unauthorised use or distribution of the Digital Product.

4. Delivery, Access, and Format

  • Access: Upon successful payment, you will receive immediate access to the Digital Product via a download link sent to your provided email address.

  • Link Expiration: Download links are active for 7 days or 3 attempts from the time of purchase. It is your responsibility to download and back up your purchase within this period. We are not responsible for re-sending links after this period.

  • Format: The Recordings are provided in the MP3 format. We are not responsible for compatibility issues arising from using the files on unsupported or outdated devices/software.

5. Returns and Refunds Policy

  • Due to the nature of digital goods, which cannot be returned, all sales are final and non-refundable, except as required by law.

  • Faulty Product: If the audio file you receive is technically corrupt, damaged, or cannot be accessed, please contact us at support@hypnotic-mind-adventures within 14 days of purchase. We will replace the faulty file with a working copy.

  • Buyer Error: We do not offer refunds for accidental purchases, dissatisfaction with the content, or failure to download the file within the specified time window.

6. Disclaimers and Limitation of Liability

  • No Guarantees: The Recordings are provided "as is" and are for educational, entertainment, or personal wellness purposes only. We make no express or implied warranties regarding their effectiveness or results.

  • Health Disclaimer: The Recordings are not a substitute for professional medical or psychological advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions you may have regarding a medical condition. Use of the Recordings is at your own risk.

  • Liability: To the maximum extent permitted by law, Hypnotic Mind Adventures shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Digital Product.
